BILASPUR,CG,INDIA: The double bench of Chhattisgarh High Court has given a historic decision in favour of the farmers, in the case of 500 acres of land in Naya Raipur.
The court said, NRDA will have to reach agreement with the farmers again, because under the new law, consent of 75% farmers is required. This will not only lead to a change in the strategies of the government and NRDA, but will also affect the progress of the scheme.
Impact of the new law: The new law will affect the processes done under the old Land Acquisition Act.
Time Limit: If publication of Section 6 is before 01/01/2014, land acquisition award is required to be given within one year.
Void: If land acquisition award is given after the time limit, it will become void.
Farmers' consent: Under the new law, consent of 75% farmers is mandatory.
President of Nava Raipur Kisan Sangharsh Samiti, Rupan Chandrakar has welcomed the decision of the High Court. He said that this is a decision taken on a Rikovillage. About 96 petitions related to the acquisition of thousands of acres of land in Nava Raipur are filed in the court. Decision is yet to be taken on other petitions of farmers.
“We have tried many times to find a solution by talking to the government, but talks are not happening right now from the present government. After the formation of the BJP government, we also met Housing Minister OP Choudhary. The minister had talked about holding a meeting soon, but till now no meeting has been held between the farmers of Nava Raipur with the new government,” he adds. It is expected that the decision on the demands and problems of the farmers will be taken only through the High Court.
