Chhattisgarh amends 117-yr-old Registration Act 1908

RAIPUR,CG,INDIA: The state government of Chhattisgarh has made a significant amendment to the 117-year-old Registration Act of 1908. Under the new changes, if a person fraudulently registers a property using another individual, the Inspector General of Registration (IG Registry) now has the authority to cancel such registrations. Previously, such cases could only be resolved through court proceedings, which often took years, allowing fraudulent registrations to remain valid.

The amendment allows the state government to modify the Registration Act to prevent unauthorized property transfers. If an investigation by the District Collector reveals that government land or public sector land was illegally transferred using fraudulent documents without following the prescribed procedure, the Collector can recommend canceling the registration. Based on this recommendation, the Inspector General of Registration or the state government itself can revoke the fraudulent registry.

If a registration is canceled by the IG Registry or through a government notification, the affected person has the right to appeal. They must submit their appeal to the Secretary of the Registration Department within 30 days of the cancellation order. The Secretary will then decide whether to uphold or revoke the cancellation.

The amendment also specifies conditions under which a registry can be canceled. If an investigation finds that a property registration was carried out using an impersonator, the execution was falsely accepted, or required permissions from authorities were not obtained, the registration will be voided. Additionally, if the state government has banned the sale of certain properties through official notification, any unauthorized registry of such land will also be canceled.
